Terms of Service
- Themely is free for personal use and is supported by ads. There are no subscriptions or in-app purchases.
- You keep ownership of the photos and text you put into your widgets. We own the app, its artwork and its designs.
- Do not copy, resell or misuse the app or its content, and do not interfere with its ads.
- The app is provided "as is". iOS, not Themely, places widgets and sets wallpapers.
1. Acceptance of these Terms
These Terms of Service ("Terms") are an agreement between you and Khanh Thong Le ("we", "us", "our"), the developer and App Store seller of Themely, based in Vietnam, for your use of the Themely iOS app and its widget extension ("the app"). By downloading, installing or using Themely, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the app.
2. License to use the app
We grant you a personal, non-exclusive, non-transferable, revocable license to install and use Themely on Apple devices that you own or control, for your own non-commercial use, as permitted by these Terms and the Apple Media Services usage rules. Wallpapers you save may be used as your own device wallpaper. This license does not transfer ownership of the app or its content to you.
3. Acceptable use
You agree not to:
- use the app for any unlawful purpose or in breach of these Terms;
- copy, modify, distribute, sell, sublicense or publicly display the app, its wallpapers, themes or widget designs as a product or collection, except where the law allows it;
- reverse engineer, decompile or disassemble the app, or try to extract its source code, except where the law expressly permits it;
- block, manipulate or generate fake views, clicks or rewards on ads, or use automated means to interact with the app;
- interfere with the app's security or with the services it relies on.
4. Your content and responsibilities
Themely lets you add your own text and choose a photo from your library to display in a widget. This content stays on your device. It is not uploaded to us and not shared with other users, because the app has no account, social or sharing features. You keep all rights to your content and are responsible for having the right to use it. We do not claim any license to it.
You are responsible for the security of your device and your Apple account, and for any content you choose to display on your Home Screen or Lock Screen.
5. Intellectual property
The app and everything in it, including its software, wallpapers, artwork, themes, widget designs, layouts, graphics, the Themely name and logo, belongs to us or our licensors and is protected by intellectual property laws. Apart from the license in section 2, no rights are granted to you.
6. Advertising and third-party services
Themely is free because it shows ads, including banner, native, interstitial, app-open and rewarded ads, served by Google AdMob and its mediation partners. Ads may link to third-party websites, apps, products or services. Those are run by third parties, and we are not responsible for their content, offers or practices. Before you save a wallpaper or widget, or apply a theme, the app may show a rewarded ad. Ad availability depends on the ad networks, and we do not guarantee that any ad will be available.
The app also uses third-party analytics, configuration and attribution services, which are described in our Privacy Policy. Your use of those services may also be subject to their own terms.
7. Price, purchases and subscriptions
Themely is free to download and use. All content in the app is free. The app offers no in-app purchases, subscriptions or paid features, and it never asks for payment information. If we introduce paid features in the future, we will update these Terms first and show the price and conditions in the app before any purchase.
8. Apple App Store terms
You obtained Themely from the Apple App Store, so the following also applies:
- These Terms are between you and Khanh Thong Le only, not Apple. We, not Apple, are solely responsible for the app and its content.
- Apple has no obligation to provide maintenance or support for the app.
- If the app fails to conform to any applicable warranty, you may notify Apple, and to the maximum extent permitted by law Apple has no other warranty obligation for the app.
- We, not Apple, are responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to meet legal or regulatory requirements, consumer protection claims, and claims that the app infringes a third party's intellectual property.
- You represent that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
- Your use of the app is also subject to the Apple Media Services Terms and Conditions.
9. Disclaimers
The app is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement, to the maximum extent permitted by law. We do not guarantee that the app will be uninterrupted, error-free or compatible with every device or iOS version.
iOS controls how widgets refresh and does not let any third-party app add widgets or set your wallpaper for you. You complete those steps yourself in the system interface. Battery and time information shown in widgets may be delayed by the iOS refresh schedule. We may add, change or remove content and features at any time.
10. Limitation of liability
To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or goodwill, arising from your use of or inability to use the app, from third-party ads or services, or from changes to or removal of content. Because the app is free, our total liability for any claim relating to it is limited to USD 10. Nothing in these Terms limits liability that cannot be limited under applicable law, including your statutory consumer rights.
11. Termination
You may stop using Themely at any time by deleting it from your device. Deleting it also removes your on-device designs, photos and settings. We may suspend or end your license if you breach these Terms. Sections 4 to 10 and 13 survive termination.
12. Changes to these Terms
We may update these Terms from time to time. We will publish the updated Terms on this page with a new "Last updated" date and, for material changes, give notice in the app or on its App Store page. If you keep using the app after the changes take effect, you accept the updated Terms.
13. Governing law
These Terms are governed by the laws of Vietnam, without regard to conflict-of-laws rules. This does not take away any mandatory protection you have under the consumer laws of the country where you live, and you may bring a claim in the courts there where those laws allow it.
