Terms of Service
Summary
By installing or using Emoji Battery: Charging Show, you agree to these Terms. The app is provided free of charge for personal use and is supported by advertising. It runs on your device, does not require an account, and is provided "as is." Please use it lawfully and respect our intellectual property.
1. Acceptance of Terms
These Terms of Service ("Terms") form an agreement between you and EXO Studio ("we", "us"), based in Hanoi, Vietnam, governing your use of the Emoji Battery: Charging Show Android app ("the app"). By downloading, installing, or using the app, you agree to these Terms. If you do not agree, do not use the app.
2. License to Use the App
We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the app on devices you own or control, for your personal, non-commercial use, subject to these Terms and to Google Play's terms. All rights not expressly granted are reserved.
3. Acceptable Use
You agree not to:
- copy, modify, reverse engineer, decompile, or attempt to extract the source code of the app, except to the extent this restriction is prohibited by law;
- rent, lease, sell, sublicense, or redistribute the app;
- use the app to violate any law or the rights of others;
- interfere with, disrupt, or attempt to gain unauthorized access to the app or the advertising services it uses;
- remove or obscure any advertising, notices, or proprietary marks.
4. Your Content and Responsibilities
The app lets you personalize the overlay, including selecting a background image from your own device. Any image or content you choose remains on your device; the app does not upload it to us. You are solely responsible for ensuring you have the right to use any image you select and that your use complies with applicable law. You are responsible for enabling permissions (such as display-over-other-apps and the accessibility service) and for how you configure the overlay on your device.
5. Intellectual Property
The app, including its design, code, graphics, icons, and other materials we provide (excluding content you supply), is owned by EXO Studio and protected by intellectual property laws. Emoji glyphs are rendered by your device's operating system and belong to their respective owners. These Terms do not transfer any ownership rights to you.
6. Third-Party Services and Advertising
The app is supported by advertising served through Google AdMob. Your use of ad-supported features is also subject to Google's applicable terms and privacy practices. Advertisements and any linked third-party content are provided by third parties, and we are not responsible for their content, accuracy, or practices. How advertising data (including the Advertising ID) is handled is described in our Privacy Policy.
7. Disclaimers
The app is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be uninterrupted, error-free, or compatible with every device or Android version. Battery readings, Wi-Fi indicators, and other displayed information are provided by your device's operating system and are for convenience only; they may not always be accurate.
8. Limitation of Liability
To the maximum extent permitted by law, EXO Studio and its team will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from or related to your use of or inability to use the app. Because the app is provided free of charge, our total liability for any claim relating to the app will not exceed the greater of the amount you paid for the app (which is typically zero) or USD 10.
9. Termination
You may stop using the app at any time by uninstalling it. We may suspend or terminate your license if you breach these Terms or if we discontinue the app. Sections that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will continue to apply.
10. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "last updated" date at the top of this page. Your continued use of the app after changes take effect means you accept the revised Terms.
11. Governing Law
These Terms are governed by the laws of Vietnam, without regard to its conflict-of-laws rules. Nothing in these Terms limits any mandatory consumer-protection rights you may have under the laws of your country of residence.
