1. Acceptance of terms

These Terms of Service ("Terms") govern your use of the VerbaBloom AI Android application (the "app") provided by EXO Studio, Hanoi, Vietnam ("we", "us", "our"). By downloading, accessing, or using the app, you agree to these Terms. If you do not agree, do not use the app.

2. License to use the app

We grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use the app on devices you own or control, for your personal, non-commercial English-learning purposes, subject to these Terms.

3. Acceptable use

You agree not to:

• use the app for any unlawful purpose or in violation of applicable law;
• attempt to disrupt, overload, reverse engineer, or gain unauthorized access to the app or its backend;
• submit content that is illegal, abusive, or infringes the rights of others;
• use the app to develop a competing service or to bypass usage limits.

4. Your content and responsibilities

You are responsible for the text and speech you submit to the app. When you use the AI tutor and related features, the text you provide is sent to our backend and to an AI language-model provider to generate responses, as described in our Privacy Policy. Do not submit sensitive personal information you would not want processed for this purpose. You retain ownership of the content you create; you grant us permission to process it solely to provide the requested tutoring features.

5. Intellectual property

The app, including its design, text, graphics, and software, is owned by EXO Studio or its licensors and is protected by intellectual property laws. Except for the license granted above, no rights are transferred to you.

6. Third-party services

The app relies on an AI language-model provider to generate responses and on your device's speech-recognition and text-to-speech engines for voice features. Your use of those underlying services may be subject to the respective provider's terms. We are not responsible for third-party services we do not control.

7. Disclaimers

The app is provided "as is" and "as available," without warranties of any kind, whether express or implied. AI-generated corrections, translations, and explanations are provided for educational purposes and may contain errors; they are not a substitute for professional or certified language instruction. We do not warrant that the app will be uninterrupted, error-free, or accurate.

8. Limitation of liability

To the maximum extent permitted by law, EXO Studio will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data or goodwill, arising from your use of or inability to use the app. Nothing in these Terms excludes liability that cannot be excluded under applicable law.

9. Termination

You may stop using the app at any time by uninstalling it. We may suspend or terminate access to the app or its backend if you breach these Terms or to protect the service. Sections that by their nature should survive termination will continue to apply.

10. Changes to these terms

We may update these Terms from time to time. We will revise the "last updated" date above and, for material changes, provide notice within the app where appropriate. Continued use after changes take effect constitutes acceptance.

11. Governing law

These Terms are governed by the laws of Vietnam, without regard to conflict-of-law principles. Disputes will be subject to the competent courts located in Hanoi, Vietnam, unless mandatory local law provides otherwise.
