1. Acceptance of these terms

These Terms of Service ("Terms") govern your use of the iOS application Smart Caller ID (the "App"), published by EXO Studio ("EXO Studio", "we", "us", or "our"), based in Hanoi, Vietnam. By downloading, installing, or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the App.

2. The App & license

Smart Caller ID helps you identify who is calling by matching phone numbers against the contacts on your device. Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to download and use the App on Apple devices that you own or control, for your own personal and non-commercial use. No account or sign-in is required to use the App.

3. Caller identification & accuracy

Caller identification is based on matching numbers against the contacts stored on your device and on the information available to the App. While we aim to identify callers helpfully, we do not guarantee that every number will be recognized or labeled correctly, and results may be incomplete, delayed, or inaccurate. You should not rely on the App to make decisions where accuracy is critical, and the App is not a substitute for your own judgment about whether to answer, block, or return a call. The App does not record calls. Any reliance you place on caller information is at your own risk.

4. Advertising

Smart Caller ID is free and supported by advertising. By using the App you acknowledge that it displays ads served through Google AdMob and its mediation partners. Advertising and your related privacy choices (including Apple's App Tracking Transparency and, in some regions, a consent prompt) are described in our Privacy Policy. We are not responsible for the content of third-party ads or for any websites or products they link to.

5. In-app purchases

The App may offer optional in-app purchases, such as removing ads or unlocking premium features. Purchases are processed by Apple through the App Store using your Apple ID and are subject to Apple's terms. Prices and availability may change. Except where required by law or Apple's policies, purchases are non-refundable; refund requests are handled by Apple. If a purchase unlocks a feature, that feature is provided on the same "as is" basis as the rest of the App.

6. Acceptable use

You agree not to:

• use the App for any unlawful purpose or in violation of these Terms;
• use the App to harass, stalk, threaten, or otherwise harm any person, or to violate the privacy of others;
• copy, modify, distribute, sell, lease, or create derivative works of the App;
• reverse-engineer, decompile, or attempt to extract the source code of the App, except where permitted by law;
• interfere with, disrupt, or attempt to gain unauthorized access to the App, our servers, or any partner systems; or
• misuse advertising or attempt to generate invalid ad activity.

7. Intellectual property

The App, including its design, user interface, original text, graphics, and software (excluding third-party trademarks and content), is owned by EXO Studio and protected by intellectual-property laws. Except for the license granted above, no rights are transferred to you.

8. Third-party services

The App relies on third-party services, including advertising and analytics partners (Google AdMob and Google Firebase), and Apple's App Store and in-app purchase system. Your use of those services may be subject to their own terms and privacy policies. We are not responsible for the practices, content, or availability of third-party services. This App is also subject to Apple's App Store Terms of Service, and Apple is not a party to these Terms but is a third-party beneficiary entitled to enforce them.

9. Disclaimers

THE APP AND ALL DATA AND CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT CALLER INFORMATION WILL BE ACCURATE OR COMPLETE.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, EXO STUDIO AND ITS SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE APP OR YOUR RELIANCE ON ANY CALLER INFORMATION IT DISPLAYS. NOTHING IN THESE TERMS LIMITS LIABILITY THAT CANNOT BE LIMITED UNDER APPLICABLE LAW.

11. Termination

You may stop using the App and uninstall it at any time. We may suspend or terminate your access to the App, in whole or in part, at any time if you violate these Terms or if we discontinue the App. Provisions that by their nature should survive termination (including intellectual-property, disclaimer, and liability provisions) will survive.

12. Changes to these terms

We may update these Terms from time to time to reflect changes to the App or legal requirements. When we make material changes, we will update the "Last updated" date above. Your continued use of the App after the changes take effect constitutes your acceptance of the revised Terms.

13. Governing law

These Terms are governed by the laws of Vietnam, without regard to its conflict-of-laws principles, except where mandatory consumer-protection laws of your country of residence apply. Nothing in these Terms affects statutory rights you may have as a consumer that cannot be waived by agreement.
