1. Acceptance of Terms

These Terms of Service (the "Terms") form a binding agreement between you and EXO Studio ("EXO Studio", "we", "us", or "our"), the publisher of the RemoteTV mobile application for iOS (the "App"). By downloading, installing, accessing, or using the App, you confirm that you have read, understood, and agree to be bound by these Terms.

If you do not agree with any part of these Terms, you must not download or use the App, and you should remove it from your device.

You must be old enough to form a binding contract in your country of residence, and old enough to hold or use an Apple ID under Apple's terms. If you are using the App under the supervision of a parent or legal guardian, that person must review and accept these Terms on your behalf.

These Terms are between you and EXO Studio only. Apple Inc. is not a party to these Terms and is not responsible for the App or its content.

2. License to Use the App

Subject to your compliance with these Terms, EXO Studio grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to download and use the App on Apple-branded devices that you own or control, in accordance with the Usage Rules set out in Apple's App Store Terms of Service.

This licence is granted for your personal, non-commercial use of the App's remote-control features with compatible televisions and media devices. It does not transfer any ownership rights to you. EXO Studio and its licensors retain all rights, title, and interest in and to the App.

Except to the extent that applicable law expressly prohibits such a restriction, you may not:

• copy, modify, adapt, translate, or create derivative works of the App;
• reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App;
• rent, lease, lend, sell, sublicense, distribute, or otherwise transfer the App to any third party;
• remove, obscure, or alter any proprietary notices contained in or displayed by the App; or
• use the App in any manner not permitted by these Terms or applicable law.

Any future updates, upgrades, or new versions of the App provided by EXO Studio are also governed by these Terms unless a separate licence accompanies them.

3. Acceptable Use

The App is intended to help you operate televisions and media devices that you own or that you have permission to control. You agree to use the App lawfully, respectfully, and only for its intended purpose.

You agree that you will not:

• use the App to control, interfere with, or attempt to access any device that you do not own or are not authorised to control;
• use the App in any way that disrupts, damages, or impairs a network, device, or another person's use of their equipment;
• use the App to violate any applicable law, regulation, or third-party right;
• attempt to gain unauthorised access to the App, its systems, or any connected device;
• use automated means, bots, or scripts to interact with the App in ways that are not part of its normal operation;
• use the App in any situation where a failure or delay could lead to death, personal injury, or serious physical or environmental damage; or
• use the App in a way that misrepresents your affiliation with EXO Studio or with any device manufacturer.

Using a remote-control app in a shared, public, or workplace environment may be subject to rules set by the owner of the equipment or the venue. It is your responsibility to comply with those rules.

4. User Content & Responsibilities

The App does not host, provide, stream, or distribute any television programming, films, music, or other media content. Any content you view or play on your television or media device comes from that device, from your own media sources, or from services provided by third parties, and is subject to the terms of those sources or services.

If you choose to send us information voluntarily — for example, feedback, bug reports, or suggestions by email — you grant EXO Studio a non-exclusive, worldwide, royalty-free, perpetual, irrevocable licence to use, reproduce, adapt, and incorporate that feedback to operate and improve the App, without any obligation of compensation or attribution to you. Please do not send us information you consider confidential or that you are not free to share.

You are responsible for:

• your device, your television or media device, and the network you connect them to;
• ensuring you have the right to control any device you use the App with;
• the content you choose to play or display through your devices; and
• any charges from your network operator or internet provider arising from your use of the App.

5. Intellectual Property

The App, including its software, source code, interface design, layout, graphics, icons, text, and the "RemoteTV" and "EXO Studio" names and logos, is owned by EXO Studio or its licensors and is protected by copyright, trademark, and other intellectual property laws in Vietnam and internationally.

Nothing in these Terms transfers to you any right, title, or interest in the App or in EXO Studio's intellectual property, other than the limited licence described in Section 2.

All product names, brands, trademarks, and logos of television and media device manufacturers that may appear in or in connection with the App are the property of their respective owners and are used solely to identify device compatibility. RemoteTV is an independent application. EXO Studio is not affiliated with, authorised by, endorsed by, or sponsored by any television or device manufacturer, and no such affiliation or endorsement is implied.

6. Third-Party Services

The App is distributed through the Apple App Store and runs on Apple's operating systems. Your download and use of the App is also subject to Apple's applicable terms, including the App Store Terms of Service and Usage Rules.

The App operates alongside televisions, media devices, and home networks made and maintained by third parties. Those devices, their firmware, their remote-control protocols, and any services they offer are outside EXO Studio's control. We do not operate them, we cannot guarantee their availability or behaviour, and we are not responsible for them. Changes made by a manufacturer — such as a firmware update that alters or removes remote-control support — may affect how the App works with your device, and such changes are not within our control.

Your use of any third-party device or service is governed by that third party's own terms and policies, and you should review them.

7. Disclaimers (Provided "As Is")

To the maximum extent permitted by applicable law, the App is provided on an "as is" and "as available" basis, without warranties or conditions of any kind, whether express, implied, statutory, or otherwise.

EXO Studio expressly disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from a course of dealing or usage of trade.

Without limiting the foregoing, EXO Studio does not warrant that:

• the App will be compatible with any particular television, media device, model, firmware version, or network configuration;
• the App will operate without interruption, delay, or error, or that every command will be delivered or executed;
• defects in the App will be corrected; or
• the App will meet your requirements or expectations.

Device compatibility depends on factors outside our control, including the capabilities of your television or media device, its settings, its firmware, and the quality and configuration of your local network. The App is a convenience tool and is not a substitute for the physical remote control or the manufacturer's own controls.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In that case, any implied warranties are limited to the minimum period and extent permitted by law.

8. Limitation of Liability

To the maximum extent permitted by applicable law, EXO Studio and its owners, employees, and contractors shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or relating to your use of, or inability to use, the App — whether based in contract, tort (including negligence), strict liability, or any other legal theory, and even if we have been advised of the possibility of such damages.

To the maximum extent permitted by applicable law, EXO Studio's total aggregate liability for all claims arising out of or relating to the App or these Terms shall not exceed the greater of (a) the amount you actually paid to EXO Studio for the App in the twelve (12) months preceding the event giving rise to the claim, or (b) ten United States dollars (USD 10.00).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud, for death or personal injury caused by negligence, or any other liability that a governing law does not permit to be limited. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so some of the above may not apply to you.

You acknowledge that EXO Studio, and not Apple, is responsible for addressing any claims relating to the App, including product liability claims, claims that the App fails to conform to a legal or regulatory requirement, and claims arising under consumer protection or similar legislation, subject to the limitations set out in these Terms.

9. Termination

These Terms remain in effect for as long as you use the App.

You may terminate these Terms at any time by ceasing all use of the App and deleting it from your devices.

EXO Studio may suspend or terminate your licence to use the App, with or without notice, if you materially breach these Terms, if you use the App unlawfully, or if we are required to do so by law or by a platform provider.

Upon termination, the licence granted in Section 2 ends immediately and you must stop using the App and delete it. Sections that by their nature should survive termination — including Sections 4 (as to feedback), 5, 7, 8, 11, and 12 — will continue to apply.

Refunds, where applicable, are handled by Apple in accordance with the App Store's policies. Please direct refund requests to Apple.

10. Changes to the App and Terms

We may update, modify, add, or remove features of the App at any time in order to improve it, maintain compatibility with new devices or operating system versions, address technical issues, or comply with legal requirements. We may also discontinue the App entirely. We are not obligated to provide updates, support, or maintenance for any particular version of the App.

We may revise these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page and post the revised Terms here. If a change is material, we will make reasonable efforts to give notice through the App or on this page before it takes effect.

Your continued use of the App after revised Terms take effect constitutes your acceptance of them. If you do not agree to the revised Terms, you should stop using the App and delete it from your devices.

11. Governing Law

These Terms and any dispute or claim arising out of or in connection with them or the App are governed by the laws of the Socialist Republic of Vietnam, without regard to conflict-of-law principles.

Any dispute that cannot be resolved informally shall be submitted to the competent courts of Hanoi, Vietnam, and you and EXO Studio consent to the exclusive jurisdiction and venue of those courts.

If you are a consumer resident in a jurisdiction whose mandatory consumer protection laws grant you additional rights or require a different forum, nothing in this section deprives you of the protection of those mandatory provisions or of your right to bring proceedings where such laws permit.

If any provision of these Terms is held to be invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect. Our failure to enforce any right or provision is not a waiver of that right or provision. These Terms constitute the entire agreement between you and EXO Studio regarding the App and supersede any prior agreements on that subject.
