Terms of Service
1. Acceptance of these Terms
These Terms of Service ("Terms") govern your use of LingoMate: AI Tutor ("the App"), published by EXO Studio, Hanoi, Vietnam. By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.
2. License to use the App
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial language learning, subject to these Terms and Apple's App Store terms.
3. Acceptable use
You agree to use the App lawfully and not to misuse, disrupt, overload, or attempt to reverse-engineer, decompile, or circumvent any part of the App or its services, except where such restriction is prohibited by law.
4. AI-generated content
Tutoring responses are generated by an automated AI system and may be inaccurate, incomplete, or unsuitable for a given context. The App is a learning aid and is not a substitute for professional instruction. You are responsible for how you use the content it produces.
5. Your content and responsibilities
You are responsible for the text and speech you submit for practice. You agree not to submit content that is unlawful, abusive, or infringes the rights of others. We may limit or suspend access to protect the service or its users.
6. Intellectual property
The App, its design, and its original content are owned by EXO Studio and are protected by applicable laws. These Terms do not grant you ownership of the App.
7. Third-party services
The App uses third-party services to function, including Apple's speech recognition and text-to-speech and an AI service (OpenCode Zen or our secure backend) to generate responses. Your use of those features may also be subject to the relevant provider's terms. See our Privacy Policy for details on data handling.
8. Disclaimer of warranties
The App is provided "as is" and "as available" without warranties of any kind, express or implied, including fitness for a particular purpose. We do not guarantee that the App will be uninterrupted, error-free, or that AI responses will be accurate.
9. Limitation of liability
To the maximum extent permitted by law, EXO Studio shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of, or inability to use, the App.
10. Termination
You may stop using the App at any time by deleting it. We may suspend or terminate access if you breach these Terms or to protect the service. Provisions that by their nature should survive termination will continue to apply.
11. Changes to these Terms
We may update these Terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.
12. Governing law
These Terms are governed by the laws of Vietnam, without regard to conflict-of-law principles, except where mandatory consumer-protection laws of your place of residence apply.
