Terms of Service for Hairify: AI Hair Changer

1. Acceptance

By downloading, installing, or using Hairify: AI Hair Changer (the "App", bundle com.exo.hairify), you agree to these Terms of Service ("Terms") and our Privacy Policy. If you do not agree, do not use the App. These Terms are between you and EXO Studio, Hanoi, Vietnam ("we," "us," or "our").

2. Eligibility

You must be at least 13 years old. If you are under the age of majority in your jurisdiction, you may use the App only with a parent or guardian who agrees to these Terms. The App is not available where prohibited by law or applicable sanctions.

3. License

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices you own or control, for personal, non-commercial use. You may not copy, modify, distribute, sell, lease, reverse engineer, or extract the source code of the App except where that restriction is prohibited by law.

4. Apple App Store EULA Addendum (iOS)

1. These Terms are between you and EXO Studio only, not Apple. Apple is not responsible for the App or its content.
2. The license is limited to use on Apple-branded devices you own or control, per the Apple Media Services Terms, including Family Sharing where applicable.
3. EXO Studio, not Apple, is solely responsible for maintenance and support.
4. To the extent not disclaimed, EXO Studio is responsible for warranties. If the App fails to conform to any applicable warranty, you may notify Apple, and Apple may refund any purchase price for the App; Apple has no other warranty obligation.
5. EXO Studio, not Apple, is responsible for product-liability, legal/regulatory, and consumer-protection claims relating to the App.
6. EXO Studio, not Apple, is responsible for investigating and defending third-party intellectual-property claims relating to the App.
7. You represent that you are not in an embargoed country or on a prohibited-parties list.
8. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

5. Acceptable Use

You agree not to:

• Upload photos of other people without consent, or photos of minors;
• Create unlawful, harassing, hateful, defamatory, or sexually explicit content, or depict a real person falsely or harmfully;
• Misrepresent generated images as authentic, unaltered photographs in a deceptive way;
• Infringe intellectual-property, privacy, or publicity rights;
• Reverse engineer, scrape, overload, or interfere with the App or our servers, or bypass usage limits or safety controls;
• Use the App for any illegal purpose.

We may suspend or terminate access for violations.

6. Your Photos & Content

You keep ownership of the photos you upload. You grant us a worldwide, non-exclusive, royalty-free license to host, transmit, and process that content to operate and provide the App, as described in our Privacy Policy. You represent that you have all rights needed to upload your content and the consent of any identifiable person depicted. Gallery items saved on your device are not uploaded to us.

7. AI-Generated Output

Important: The App uses AI to generate images. Output can be inaccurate, unrealistic, distorted, or unexpected, and may not reflect how you or any hairstyle would actually look. Generated images are for entertainment and personal, non-commercial use only. Do not rely on them for any important decision, and do not present them as genuine unedited photographs in a misleading way. You are responsible for how you use and share them.

8. Ads, Pricing & Purchases

The App is free to download and is supported by third-party advertising (see the Privacy Policy for how ads and tracking work). It also offers an optional in-app purchase of consumable generation credits ("5 AI Hairstyle Credits", product com.exo.hairify.credits5); the price is shown in the App before you buy. There are no auto-renewing subscriptions. All purchases are processed by Apple through your App Store account — we never receive your card details. Consumable credits are generally non-refundable once delivered, except where required by law; refunds are handled by Apple.

9. Intellectual Property

The App, including its software, design, logos, text, and the "Hairify" name, is owned by EXO Studio or its licensors. Except for the license in Section 3, these Terms grant you no rights in our intellectual property. Subject to the rights of any third parties depicted, you may use images the App generates from your own photos for your personal purposes. Feedback you send us may be used without obligation to you.

10. Third-Party Services

The App's AI generation runs on cloud infrastructure from Modal Labs, Inc., is distributed via the Apple App Store, and integrates third-party advertising, analytics, and attribution services (Google AdMob with AppLovin and Mintegral mediation, Google Firebase, Adjust, Meta, and TikTok), as described in Privacy Policy Section 5. Your use of those services is also governed by their terms and privacy policies. We are not responsible for third-party services, their content, or their availability.

11. Privacy

Your use of the App is governed by our Privacy Policy, which explains how we collect, use, and share information, including the photos you upload. By using the App, you acknowledge you have read it.

12. Disclaimers

The App is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, or statutory, to the maximum extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty that the App will be uninterrupted, error-free, secure, or that AI output will be accurate.

Some jurisdictions do not allow certain warranty exclusions; where applicable consumer law prohibits these disclaimers, they apply only to the extent permitted, and you may have additional mandatory rights.

13. Limitation of Liability

To the maximum extent permitted by law, EXO Studio and its suppliers will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, data, goodwill, or reputation, arising out of or relating to your use of the App. Our total aggregate liability for all claims relating to the App will not exceed the greater of the amount you paid us in the 12 months before the claim or twenty U.S. dollars (US$20).

Nothing in these Terms excludes liability that cannot be excluded under applicable law.

14. Indemnification

You agree to indemnify and hold harmless EXO Studio from claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of the content you upload, your violation of these Terms, or your violation of any law or third-party right, including the rights of any person depicted in a photo you upload.

15. Termination

You may stop using the App at any time and delete it. We may suspend or terminate access if you violate these Terms, if required by law, or if we discontinue the App. Sections that by their nature should survive (including 6, 9, 12, 13, 14, and 17) survive termination.

16. Changes

We may update these Terms. For material changes we update the "Last Updated" date and provide reasonable notice, such as an in-app notice. Continued use after changes take effect means you accept them.

17. Governing Law

These Terms are governed by the laws of the Socialist Republic of Vietnam, without regard to conflict-of-laws rules. Disputes will be subject to the competent courts of Vietnam. If you are a consumer, you may also benefit from mandatory protections of the law of your country of residence, and nothing here deprives you of those rights.
