Terms of Service
TL;DR
- Only upload photos of yourself, or of adults who agreed to it. Don't use results to deceive, harass or impersonate anyone.
- Results are generated automatically by AI and may not look the way you expect.
- Credits are consumable Apple in-app purchases, have no cash value, and are returned automatically if a creation fails on our side.
- Our servers delete results after 24 hours, so save the ones you want to keep.
1. Acceptance of these terms
These Terms of Service ("Terms") are an agreement between you and EXO Studio, Hanoi, Vietnam ("EXO Studio", "we", "us") for the Aivio: Mood Video Studio app for iPhone ("Aivio" or "the app"). By downloading or using the app you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the app. These Terms apply in addition to Apple's Licensed Application End User License Agreement; if they conflict, Apple's terms govern your relationship with Apple.
2. The service
Aivio creates AI-styled results from one selfie you provide, such as a "Time Machine 1995" retro portrait or a "Mood Clip · Crying" video when that effect is available. The app checks your photo on your device, then uploads it to our servers to create the result, as described in the Privacy Policy. Results are generated automatically and may be inaccurate, unflattering or different from what you expect. Aivio does not require you to create an account: the app creates an anonymous account on your device to keep your credit balance.
3. Eligibility
You must be at least 13 years old, or the minimum age required in your country to use the app and consent to the processing of your data if that is higher. If you are under the age of majority where you live, you may use the app and buy credits only with the permission of a parent or guardian.
4. License to use the app
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to use the app on Apple devices that you own or control, for your personal, non-commercial use. You may not copy, modify, reverse engineer, decompile or resell the app, interfere with its servers, bypass its credit or security systems, or access it through automated means except as the law expressly permits.
5. Your photos and results
- Only upload photos of yourself, or of adults who have given you permission to do so. Do not upload photos of minors, nudity or sexual content, or anything unlawful.
- You keep any rights you have in your photos and results. You give us and our service providers a limited permission to process the photo you choose only to create and deliver your result, as described in the Privacy Policy. This permission ends when the photo and result are deleted from our servers.
- You are responsible for the photos you upload and for how you use and share results, including obtaining any permissions needed from the people shown.
- Our servers delete uploaded photos when processing ends and delete results after 24 hours. Keep your own copies of results you want; we are not a storage service.
6. Acceptable use
You agree not to use Aivio or its results to:
- deceive others, including presenting a result as a real photo or video of a real event;
- harass, bully, defame, impersonate or sexualize any person;
- infringe anyone's privacy, publicity, copyright or other rights;
- create or share content that is unlawful, hateful or harmful; or
- attempt to disrupt, overload, probe or abuse our servers or the credit system.
We may refuse to process a photo, and suspend access, if we reasonably believe these rules are being broken.
7. Credits and purchases
Creations use credits. Credits are sold as consumable in-app purchases through Apple's App Store in the following packs:

- Prices are shown in the App Store in your local currency before you buy. The credit cost of each effect is shown in the app before you create; currently Time Machine 1995 costs 25 credits and Mood Clip · Crying costs 100 credits.
- Payment is processed by Apple and charged to your Apple Account. There are no subscriptions and no automatic renewals.
- Credits are reserved when you start a creation and charged only when it succeeds. If a creation fails on our side or does not finish in time, the reserved credits are returned automatically.
- Credits have no cash value, cannot be exchanged for money, and are not transferable. They are tied to the anonymous account stored in your device Keychain, so deleting the app or changing devices may make them unavailable. Use Restore in Preferences to sync purchases with the App Store.
- Refunds are handled by Apple under Apple's policies. If Apple refunds a purchase, the credits it added are removed from your balance.
- Nothing in these Terms limits any consumer rights that cannot be excluded under the law of your country.
8. Intellectual property
The app, its design, effects, text, graphics, software and trademarks are owned by EXO Studio or its licensors and are protected by law. Except for the license in section 4 and your rights in your own photos and results, these Terms do not give you any rights in them.
9. Third-party services and ads
The app relies on third-party services, including Apple (App Store and payments), Google (Firebase and AdMob) and our cloud and processing providers, as listed in the Privacy Policy. Your use of those services may also be subject to their terms. The app shows ads from Google AdMob on the launch screen and first-time setup screens. We are not responsible for third-party ads, websites or content you reach through them.
10. Availability and changes to the service
We may add, change, pause or remove effects or features, including turning an effect off temporarily, and we may change credit costs for future creations. We will show the current cost in the app before you create. We do not guarantee that the app or any effect will always be available, uninterrupted or error-free.
11. Disclaimers
To the fullest extent permitted by law, the app and all results are provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. AI-generated results are for entertainment and creative purposes only and do not depict real events.
12. Limitation of liability
To the fullest extent permitted by law, EXO Studio will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, results, profits or goodwill, arising from your use of the app. Our total liability for any claim relating to the app is limited to the amount you paid for credits in the 12 months before the claim arose. Some jurisdictions do not allow these limitations, so they apply to you only to the extent the law allows.
13. Termination
You may stop using the app at any time by deleting it. You can delete your photos and results with Delete my data in Preferences. We may suspend or end your access if you materially breach these Terms or misuse the service. Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability and governing law) survive termination.
14. Changes to these terms
We may update these Terms from time to time. We will post the new version on this page and update the date above. If changes are significant, we will give notice in the app or on this page before they take effect. Continuing to use the app after the changes take effect means you accept them.
15. Governing law
These Terms are governed by the laws of Vietnam, without regard to conflict-of-law rules. This does not deprive you of mandatory protections of the consumer laws of the country where you live.
